TMC Mp Mahua Moitra’s Defamation Plea Against BJP Mp Nishikant Dubey Closed By Delhi HC As Later Withdraws The Contentious Post

In a recent update, the defamatory plea filed by Trinamool Congress MP Mahua Moitra against BJP MP Nishikant Dubey and lawyer Jai Anant Dehadrai for their social media posts, has been closed by the Delhi High Court after the defendants withdrew their post.

Facts of the case-

  • The facts of the case start when back in the year 2023, TMC MP Mahua Moitra filed a defamation suit against Dubey and Dehadrai, alleging that the defendants made false claims against her that she took bribes for asking questions in the Parliament
  • The MP also demanded that the two defendants as well as certain media outlets  should be restrained from making such defamatory statements as well as must be  directed to issue public apologies to the MP in different newspapers and in multiple languages. 
  • Further the plaintiff asked the Court to pass an ex-parte injunction so as to remove from all platforms these defamatory posts, images, videos and publications, till the case was resolved. 
  • As for the controversy, it happened when Dubey complained to the Speaker of the  Lok Sabha, alleging that Mahua Moitra took bribes for raising questions in the  Parliament. Dubey made the claims based on the information he received through a letter from Dehadrai. 
  • Moitra denying the claims in the complaint against her, filed an application against  a quote tweeted by Dehadrai where he referred to the claims as "bombshell development in the Lokpal case filed by Dr. Nishikant Dubey MP. further it was claimed by Dubey on the Facebook that CBI had registered a case regarding  Moitra’s alleged foreign accounts as well as expenditures.
  • It was argued by the counsel for Dubey that the post made by him was in reaction to a comment made by Moitra where she used the word “pitbull,” which was  considered derogatory by his client. Also, it was requested that Moitra should be stopped from making such references.
  • Responding to the above claim, Moitra’s Counsel stated that the term “pitbull” was not intended for the defendant, and that the defendant was directly addressed as well as tagged in the posts made by the plaintiff.

Decision of the Court-

  • “The statement of the plaintiff is taken on record and she is bound down to the same.” said the Delhi High Court.
  • “With Moitra clearly disowning any intent to refer to Dubey as “pitbull,” the Court claimed that no further directions were needed on the matter.
  • Justice Manmeet Pritam Singh Arora disposed of the case after the Counsel for defence told the Court that the alleged Facebook post was deleted. Also, Dehadrai, assured the court that the post made by him on social media platform X would be deleted as well.
  • “In light of the fact that defendant No. 1 has already removed the another post from Facebook and that defendant No. 2 has undertaken to remove the impugned post from 'X', the relief sought in this application does not survive for consideration. The application is hereby disposed of,” said the Delhi High Court.
  • The case will be heard next on July 17th, 2025.
