- The bench observed that the people with a "Dirty Mind Perverted" mentality must bear the blame for baring vulgarity under the guise of entertainment; they stressed the need for responsible communication from the influencers, especially those who have millions of followers.
- The court called for a better enforcement of the Obscene Laws and reiterated that such remarks reflect not only at the decency of the common people but also at the very fabric of society.
- Section 292 of the Indian Penal Code, dealing with obscenity is applicable to material deemed "lascivious" or something that appeals quite directly to an individual's sexual desires.
Interim Protection and Legal Proceedings
- To prevent immediate arrest of Allahbadia, interim protection was granted by the Supreme Court, despite the seriousness of the allegations. The court directed that he submit his passport so as to stop him from fleeing during the ongoing investigations, while instructing forthe law enforcement agencies to ensure Allahbadia cooperates with the investigation.
- Advocate Abhinav Chandrachud, who was representing Allahbadia, contended that even though the statements were dubious, they would not be grounds for criminal charges. To ensure the fairness of the proceedings, the statements under Section 162 of the CrPC pertaining to police-recorded witness testimony must be taken into account.
The Role of Police Protection in the Case
- In light of public outburts and threats made against Allahbadia, the court discussed the requirement for police protection as well. The bench held that, although public figures should be held responsible for their acts, they are never supposed to be subjected to illegal threats or violence.
