Thirteen months after a 7-year-old minor girl child was sexually assaulted, killed, and as well as her body was found and discovered inside a sack, a Kolkata court condemned the girl’s neighbour to death, ruling that this particular heinous act was among the "rarest of rare" incidents.
The Protection of Children Against Sexual Offenses (POCSO) court in Scotland invoked economist and philosopher Adam Smith when imposing the sentence on Thursday, saying, "Mercy to the guilty is cruelty to the innocent."
What was the Case?
- The girl did not come home after going to the nearby shop to get a packet of milk for her apartment building.
- Her family notified law enforcement. The girl was seen leaving the milk shop and making her way home on footage captured by nearby security cameras.
- The prisoner Ashok Shaw lured the little girl who lived next door to his apartment with sweets. And then after, he sexually attacked the 7 year old girl child and as well as struck her head with the sharp object like hammer.
- A police official who had looked and investigated this horrific incident mostly found out and claimed that the minor girl's disfigured body had been discovered in the kitchen of her neighbour.
- The body of the minor girl was investigated as well as it was found with 28 different wounds.
- Shaw (the accused in the prison) was awarded with the death penalty by the Special POCSO judge Sudipto Bhattacharya appointed for the case, who referred to the crime as "the rarest of the rare".
- For this particular case Sudipto Bhattacharya (appointed POCSO Judge) named this crime as the "the rarest of the rare" as he sentenced Shaw (the prisoner) to death.
Police Inaction
- Her body was found in the prisoner's flat when the building was searched.
- When the incident of rape and murder of 7 year old girl got first reported, the relatives of the victim mostly claimed that the police did not take the situation meticulously and seriously in details. But afterward, the police official moved in and as well as took the accused into custody.
- After getting rid of some kind of trash, the accused however kidnapped the girl and took her to his home, according to the inquiry done by the police official.
- Then, in order to keep her from reporting the incident, he brought her to his apartment where he sexually molested and killed her.
- The girl was just seven years old, and the court noted that she lacked the capacity to defend herself.
Death Sentence to Kolkata Man: Court Observations
- The judge stated that the girl was exposed to a horrible crime and, due to her young age, had little opportunity of defending herself.
- The court ordered the West Bengal government to compensate the girl's mother with 10 lakh rupees under the state's victim compensation plan, and the trial was finished in less than a year.
