One Day Court Marriage Process In India, 2025

Court Marriage is a marriage which is held at the marriage office or the Sub-Registrar's office, as per the provisions laid down in the Special Marriage Act, 1954 (‘Act’), with the process being similar across the nation. 

The marriage officer would perform the marriage without any discrimination on the basis of caste, creed or religion. Court Marriage is a valid marriage which is done as per the law rather than the customs or traditions. The bride and the bridegroom could directly submit a court marriage application with the marriage officer to get a marriage certificate.

Process Of Court Marriage In One Day

In case you are planning to marry the one you love, there are various legal ways to perform the Court Marriage In One Day in India. But, it is not possible to have the entire procedure of court marriage completed in 1-2 days. It takes at least 30 days for the completion of court marriage in India. All court marriages are completed as per the Special Marriage Act, 1954.

There are various personal laws for the marriage of partners in India:-

  1. Hindu Marriage Act, 1955:– Couples belonging to the Hindu Religion including Sikh, Jain & Buddha religion could marry each other by following their traditional customs through Arya Samaj Marriage. Later, the marriage could be registered under the Hindu Marriage Act, 1955.
  2. Muslim Personal Laws:– Couples belonging to the Muslim Religion could marry each other via following the islamic traditions, i.e Nikah. Their marriage could be later registered under the Muslim Personal Law.
  3. Indian Christian Marriage Act, 1872:– In case the  couple belongs to the Christian Religion, they  could get married in a day in traditional way i.e, Church Marriage. The marriage would be later registered under the Indian Christian Marriage Act.

Eligibility Criteria For Partners for Marriage In India:- 

  • Minimum Age Criteria Of Male & Female:– Both the male & female partners should fulfill the minimum age criteria as provided by law. Male– 21 years old & Female should be at least 18 years. 
  • Forbidden Relationship:– Both parties must not have fallen under prohibited degrees of relationship or sapinda relationship. 
  • If Previously Married:– In case either of the partners wishing to get married, was married to someone else, they would have to submit the death certificate (if the previous partner has expired) or divorce decree (in case the the said partner is a divorcee).
  • Consent Of Partners:– It is important for a marriage to be legally valid that the parties involved must have given their consent for marriage. 

Court Marriage Within a Day:- 

The process of Court Marriage starts with  filing a legal notice for marriage along with other necessary documents. 

The Marriage Officer, would then provide you with a time period of 30 days from the day notice was submitted, for any other person to provide with a genuine objection as to why the marriage should not be solemnised.
